This User Agreement governs the relationship between Espiru LLC (“Carspot”) and the Internet user (“User”) arising when using the Internet resource www.carspot.co.nz and the mobile application Carspot.co.nz (Carspot.co.nz), on the terms specified in the User Agreement.
Full and unconditional acceptance of this offer by Carspot to the User to conclude an Agreement is the User’s performance of actions aimed at using Carspot.co.nz, including searching, viewing or submitting advertisements, registering on the site, leaving comments, sending messages through the form communications and other actions to use the functionality of Carspot.co.nz
The User Agreement may be changed by the Carspot at any time without any special notice to the User. The new version of the User Agreement comes into force from the moment it is posted on Carspot.co.nz, unless otherwise expressly stated by Carspot. Regular familiarization with the current version of the User Agreement is the responsibility of the User.
Use of the Carspot after the new edition of the User Agreement comes into force means the User agrees with it and applies the provisions of the new edition to him in full.

In this User Agreement, the terms specified below have the following meanings:
Carspot.co.nz is an Internet resource that is a collection of information and intellectual property objects contained in the information system (including computer programs, databases, graphical interface design (design), etc.), access to which is provided with various user devices connected to the Internet, using special software for viewing web pages (browser) at the addresses www.carspot.co.nz, carspot.co.nz and (including domains of the next levels related to these addresses) or Mobile Carspot.co.nz applications.
User is a visitor to Internet resources, including Carspot.co.nz.
User Agreement - this Agreement is located at https://carspot.co.nz/agreement/.
Services - functionality, services, services, tools available to Users on Carspot.co.nz.
Mobile application - software for portable (mobile) devices installed or downloaded by the User on such devices using various software platforms, intended for access to Carspot.co.nz.
Product - any product, product, service, job offer or other offer for which the User places an Advertisement on Carspot.co.nz. Advertisement - an information message with an offer about the Product (including contact information, photographs and any related information), posted by the User on Carspot.co.nz, addressed to an indefinite number of persons.
Seller - a User who places an Advertisement on Carspot.co.nz with an offer to conclude a transaction regarding the Product.
Buyer - a User who views an Advertisement posted by the Seller, interacts with the Seller regarding the Product and/or enters into a transaction with the Seller.
Credentials - a unique login (email address) and password created independently by the User during the Registration process on Carspot.co.nz or later changed by the User through the Personal Account, used to access the Personal Account after the User is authorized on Carspot.co.nz.< /p>
Personal Account - the User’s personal section on Carspot.co.nz, associated with the User’s account on Carspot.co.nz, in which the User can manage individual Carspot.co.nz Services.
Information - any materials and information provided by the Carspot User in connection with the use of Carspot.co.nz, including those that may be used by Carspot.co.nz for commercial purposes.
2.1. The Carspot offers the User, under the terms of this User Agreement, to use the Services available on Carspot.co.nz, including posting, searching and viewing Advertisements and other Services offered on Carspot.co.nz. Additional conditions, rules and restrictions may be established regarding the use of individual Carspot Services. Mashi has the right at any time to revise or change the terms of service, supplement, change, limit, expand the functionality of Carspot.co.nz and/or Services, including the terms of the User’s access to the Services or individual functionality of Carspot.co.nz.
2.2. Services are provided to the User free of charge, unless specifically stated otherwise.
2.3. Carspot.co.nz is a platform that allows Sellers to independently, under their own responsibility, place offers addressed to an indefinite number of persons to complete a transaction in relation to the Product, which the Seller is authorized to dispose of (make offers), and for Buyers to accept, at their own discretion and responsibility, offers posted on Carspot .kg by Sellers, concluding a corresponding transaction with the Seller.
2.4. The Carspot is not the organizer of the transaction, Buyer, Seller, intermediary, agent or representative of any User and/or other interested party in relation to the transaction proposed/concluded between Users. All transactions between Users made through the placement of an Advertisement on Carspot.co.nz are concluded and executed without the direct or indirect participation of Carspot.
2.5. Regardless of the fact of Registration or authorization of the User on Carspot.co.nz, use of Carspot.co.nz, including viewing information posted on Carspot.co.nz, means the User’s consent to this User Agreement and acceptance of obligations to follow the instructions for using the Services, as well as responsibility for actions, related to the use of Carspot.co.nz.
2.6. By accessing Carspot.co.nz and thus concluding this User Agreement, the User guarantees that he has all the rights and powers necessary to conclude and execute the User Agreement, including being an adult and fully capable person, or a minor declared by decision of the authorized body by a fully capable or minor person who has reached fourteen years of age and has received written permission in the form required by law from his parents or other legal representatives to conclude the User Agreement. The Carspot has the right at any time to require the User to provide information and documents confirming rights and authority, as stated above.
2.7. The Services provided on Carspot.co.nz can be changed, supplemented, updated, change the form and nature of functionality at any time without prior notice to the User, and therefore their use is offered in an “as is” mode, i.e. in the form and extent in which they are provided by the Carspot at the time the User accesses the Services. The Carspot has the right, if necessary, at its sole discretion, to stop (temporarily or permanently) providing the Services (or any individual functions within the Services) to all Users in general or to an individual User in particular, without prior notice.
2.8. The User undertakes not to use obscene language, insults and/or threats on the Carspot, as well as words and expressions that conflict with legal requirements and generally accepted standards of morality and morality.
2.9. Provision and use of Bonuses/Discounts.
2.9.1. In accordance with the terms of this user agreement, by decision of the Administration, the User may be provided with a discount in the form of Bonuses/Discounts. Bonuses/Discounts can be provided to the User by: providing Promo Codes to activate Bonuses, by crediting Bonuses to the User’s account, or by other means. The method of providing Bonuses is determined by the Administration independently.
2.9.2. When providing a Bonus/Discount as a percentage of the payment amount, the amount of the actual discount provided is calculated from the entire payment amount.
2.9.3. Bonuses provided to the User can be used by the User only to pay for Services on Carspot.co.nz and cannot be exchanged, transferred to third parties or replaced with a cash equivalent.
2.9.4. In the event of the User’s refusal to use Carspot.co.nz, cancellation/refusal of any Service at the initiative of the User and/or the Administration, all Bonuses previously provided to the User are burned (irretrievably debited from the account) and cannot be restored. In any case, if you refuse to use the Internet resource or a separate Service, the User may only be transferred the balance of funds, without Bonuses/Discounts.
3.1. During Registration, Credentials are specified, which the User chooses independently. After makingcollecting data for Registration, the User receives an email or SMS to the email address or phone number specified during Registration, containing the code necessary to confirm Registration on Carspot.co.nz. In this case, account registration is carried out to one User’s email address once. Repeated Registration of a new account on Carspot.co.nz using the email address previously specified during Registration is not permitted.
By registering on the site, the User agrees that the technical data about the car specified by him can be used by Carspot.co.nz for informational and commercial purposes for transfer to third parties, without the User’s consent.
3.2. The User is obliged to monitor the safety of his Credentials and not disclose them to third parties. The User does not have the right to transfer his Credentials to third parties, or directly or indirectly allow third parties to use his Credentials for authorization on Carspot.co.nz, with the exception of persons acting on behalf and in the interests of the User or who have received such Credentials on the basis of relevant agreements with User.
3.3. Any action performed from the User’s Personal Account using his Credentials is considered an action performed by the User himself or his authorized person and establishes obligations and responsibilities for the User in relation to such actions, including liability for violation of this User Agreement, legal requirements in relation to the Product, information which is posted by the User on Carspot.co.nz.
3.4. The User is obliged to immediately change the Credentials if he has reasons to suspect that these data have been disclosed or may be used by unauthorized third parties.
3.5. The machine has the right to use available technical solutions to verify the accuracy of the information provided by the User when using Carspot.co.nz. The machine cannot guarantee that the User really is who he claims to be, or that the information provided by the User on Carspot.co.nz is true. Carspot recommends that Users communicate with possible counterparties, Sellers and Buyers, using all the tools available on Carspot.co.nz, and exercise caution and caution when making transactions and choosing a Seller.
3.6. The Carspot has the right to block the User’s access to the Personal Account with or without simultaneous termination of the placement and display of his Ads if the User violates the terms of this Agreement and/or the rules for posting ads. Carspot has the right at any time to terminate and/or limit the User’s access to the Services, as well as block or delete the User’s account on Carspot.co.nz without the possibility of its restoration.
3.7. Viewing Advertisements and other information posted on Carspot.co.nz in the public domain does not require registration and/or authorization of the User, however, when performing such actions, the User is in any case obliged to comply with the provisions of the User Agreement.
3.8. The User acknowledges and agrees that when completing the registration procedure on one of the following Sites (desktop and mobile versions, as well as mobile applications) www.carspot.co.nz, www.house.kg, the User and the Vehicle have the right to use the subscriber’s initially entered by him cell phone number and email address on the websites www.carspot.co.nz and www.house.kg, and also automatically assumes compliance with the user's requirements for both Sites.
• Advertisements must not contain information that is prohibited or contrary to the legislation of the New Zealand.
• Posted advertisements are moderated - checked for correctness of completion and compliance with these rules.
• General requirements for posted advertisements:
• it is necessary to indicate reliable information in the ad (price, phone numbers, characteristics, photographs, etc.).
• the content of the ad must correspond to the category in which it is submitted. Moderators have the right to delete an ad if it does not comply with the rules for publishing ads in the submitted category.
• in the “Price” field the cost of the car must be indicated, taking into account all expenses (delivery, company commission, payment of customs duties, etc.).
• The “City” field must indicate the city in which the offer (product) is actually located.
• Prohibited:
• publish advertisements with similar content, where it is obvious that we are talking about the same offer in the same city (regardless of the date of their publication), with the exception of the “Spare parts” section.
• sell vehicles for spare parts, except for the special section of the “Spare parts” category - “Cars for spare parts.”
• indicate information in the adyu about the sale of vehicles in several copies.
• express discrimination on racial, national, religious, social grounds, propaganda of violence, hatred.
• The owner of the ad is responsible for the information contained in the ad.
• Carspot.co.nz is not responsible for transactions made by users.
• Ads that do not comply with these rules can be deleted or adjusted by the site administration at any time without permission or notification of the ad author.
• Suspicious activity in posting ads will result in account blocking.
• Comments on advertisements and articles that do not comply with these rules and the Law of the New Zealand “On Mass Media” can be deleted or adjusted at any time by the site administration without permission or notification of the author of the advertisement.
• The period for posting advertisements on the site is 20 days from the date of submission (or from the date of its extension).
• When posting an ad, the user agrees to use the Analytics service. The advertised vehicle price will be used to calculate and display the average price of similar vehicles since the ad was posted on the site.
• Advertisement text is allowed only in English languages, with the exception of special terms/abbreviations (4WD, ABS, SRS, etc.) and names (brands, models, spare parts manufacturers, etc.).
• Case as in sentences (the first letter is capital, the rest are lowercase).
• Transliteration (writing words in Latin letters) is prohibited.
• The fields of the advertisement submission form must be filled in according to their names.
• Phone numbers must be specified in the site format.
• Prohibited:
• place ads that contain repeated punctuation and/or non-letter characters in the title or text.
• place ads in the title of which the price is explicitly or implicitly indicated, as well as information about discounts and promotions.
• place advertisements whose description contains information about the company and the services it provides. The exception is the “Auto Business” section.
• indicate links to any sites or email addresses (except for the site carspot.co.nz and video hosting sites - for example, youtube.com, vimeo.com and others).
• indicate the address and opening hours in the ad text, except for the “Accessories and Multimedia” and “Oils and Auto Chemicals” headings.
• place an offer to sell a vehicle, in the absence of documents necessary for registering a vehicle in accordance with the legislation of the New Zealand.
• It is prohibited to use in advertisements images that violate the individual’s right to privacy, as well as images, the publication of which in one way or another contradicts the laws of the New Zealand.
• To ensure compliance with the rules for publishing ads and prompt removal of images that do not comply with the rules of the service, all images are checked by moderators.
• Images that violate these rules are deleted as soon as they are discovered.
• The service is not responsible for the content of images (files) published in advertisements.
• Rights to images in advertisements belong to their owners.
• The image size must be at least 400×300 pixels.
• Images must be in JPEG, PNG format.
• Place trademarks, logos, company names on photographs, the rights to which belong to third parties, except for cases that are specifically stated in the rules for posting advertisements.
• The image must not contain:
• watermarks, logos of any resources except carspot.co.nz;
• contact information (phone numbers, e-mail, contact information for Skype, WhatsApp, Viber and other messaging services);
• information about price, loans, installments and promotions;
• “festive” design and frames;
• text;
• names and addresses of sites;
• state symbols;
• fragments of erotic content;
• QR codes;
• several combined photos;
• trademarks: TOYOTA, LEXUS, Mercedes-Benz, CATERPILLAR and CAT.
• People can be depicted in photographs if they have given oral and/or written consent to the publication of such an image or such an image is part of an advertisement for a product that has been introduced into civil circulation by the copyright holder or with his consent.
• Copying images belonging to other users of the resource is prohibited.
• The image must correspond to the object being sold or we provideoh service.
7.1. Any activity related to weapons (including models, replicas, toys, etc.).
7.2. Listening devices.
7.3. Purchase and sale of documents.
7.4. Sale of organs for transplantation.
7.5. Products and services of the sex industry.
7.6. Sale of alcoholic beverages, cigarettes.
7.7. Dubious services: financial pyramids, network marketing, gambling, investment offers, sale of information about match-fixing, fortune-telling, predictions and other similar services.
7.8. Goods/services, the use of which may be aimed at violating the current legislation of the New Zealand (for example, reverse frames for car license plates, speedometer adjustment services, services for fictitious exercise of the functions of an executive body in a legal entity, etc.).
7.9. Sale of cars, goods and services through auction.
8.1. Requirements for companies:
8.1.1. Duplicate profiles are prohibited
8.1.1.1. If you already have a profile, do not create an additional one. Such actions will be suppressed by the moderator, and additional profiles will be deleted. Copying information from other people's profiles is also prohibited.
8.1.1.2. It is allowed to create only one company account per legal entity; duplicates will be deleted without refund.
8.1.2. Write the truth about yourself
8.1.2.1. Fill out your profile with accurate information. People trust more when you are honest with them.
8.1.3. About filling out your profile
8.1.3.1. Password: create a complex password; simple ones, such as “123456”, are easy to guess, and you have a chance to lose access to your account.
8.1.3.2. Names: use your real first and last name (for example, Mirbek Bazarbekov or Evgeniy Vasiliev). Nicknames from forums, random characters, etc. are not allowed.
8.1.3.3. Names of companies: it is necessary to indicate the full and exact name in accordance with the data specified in the constituent documents (for example: “The Best Company-No. 1” LLP). It is prohibited to indicate in the name the sites house.kg, carspot.co.nz, bazar.kg, as well as derivatives of such a name and those that have become known as a result of its use. It is allowed to indicate the company name in English/Latin letters.
8.1.3.4. A company is allowed to create only one business account, the name of which must match the name of the company.
8.2. Requirements for advertisements
8.2.1. These rules apply to advertisements in the following categories: auto business, spare parts stores and auto repair shops, tire and wheel stores, special equipment sellers, spare parts sellers (special equipment), car washes, driving schools, car insurance, technical inspection, tire storage.
8.2.2. The ad text should tell about the company (auto disassembly), the goods or services being sold, terms of sale and warranty (if any).
8.2.3. Placing advertisements without photographs in these sections is prohibited.
8.2.4. Text is allowed in the image, occupying no more than 30% of the image area.
8.2.5. Photos in advertisements must not contain images of TOYOTA, LEXUS, Mercedes-Benz, SUBARU, CATERPILLAR and CAT trademarks.
8.2.6. It is prohibited to create duplicates of advertisements already posted on the Carspot, including those created by other Users.
9.1. For non-compliance with these rules, as well as for activities harmful to the operation of the site, the administration reserves the right
• block your personal account and then delete all advertisements without compensation;
• add the user’s email and phone number to the “black list” for systematic violation of the rules.
9.2. The site administration may change or supplement the “Rules for Placing Ads” at any time without any prior notice to users.
10.1. Section "Auto"
10.1.1. Cars
10.1.1.1. It is allowed to place advertisements only for the sale of passenger cars.
10.1.1.2. It is prohibited to upload images processed with a graphic editor (including applying text), except in cases of changing the format, size, minor retouching and removing the GRNZ (state registration license plate).
10.1.1.3. It is allowed to place the car dealership logo in one of the corners of the image in advertisements belonging to Auto Business.
10.1.1.4. The mark “not cleared by customs” is required if the vehicle has not been cleared by customs in the Republic of New Zealand.
10.1.1.5. Allowed in one adThe sale is for one car.
10.1.1.6. If an advertisement is posted for the sale of a salvage vehicle:
• the vehicle status must be indicated as “Emergency”.
• the text of the ad must contain a description of the damage to the car.
• photographs are required that show in detail the existing damage.
10.1.1.7. When posting advertisements for the sale of cars in need of repair (with the status “Emergency” or “Not running”), the sale of cars for spare parts, separate or hidden sale of spare parts, assemblies or components of the car (including in the comments to such an advertisement) is prohibited.< /p>
10.1.1.8. An advertisement for the sale of a car without documents must be placed in the “Cars for spare parts” section.
10.1.1.9. It is prohibited to place advertisements whose description contains information about the company and the services it provides.
10.1.2. Car showrooms
10.1.2.1. It is allowed to submit advertisements from car dealerships that have premises or a demonstration area.
10.1.2.2. The ad text should tell about the car dealership, the cars being sold, the terms of sale and warranty.
10.1.2.3. It is allowed to use a company or brand logo, as well as the company name in the photo, provided there is a photograph of the salon or demonstration area.
10.2. Section "Spare parts"
10.2.1. Spare parts
10.2.1.1. It is allowed to submit advertisements for the sale of spare parts for passenger vehicles.
10.2.1.2. In the section it is allowed to place one advertisement regarding the sale of one or more units (in the form of a set, repair kit or completely identical) spare parts for passenger vehicles with a certain set of characteristics (catalog number, size, type, etc.) with the obligatory indication of the price for one unit, or per set.
10.2.1.3. The title of the ad must contain the name of a specific spare part for a passenger car, without general descriptions (for example, the title “Spare parts for cars from the USA” is incorrect. The title “Nissan Qashqai 2012 side mirror” is correct).
10.2.1.4. Advertisements for the sale of an assortment of spare parts (including car dismantling shops) should be published in the section “Spare parts stores and car dismantling shops.”
10.2.1.1. It is prohibited to indicate in the text and title of the advertisement more than one brand/model of passenger vehicles for which this spare part is suitable.
10.2.2. Auto parts
10.2.2.1. It is allowed to place an advertisement for the sale of a car intended for disassembly for spare parts.
10.2.2.2. Prohibited:
• indicate in the advertisement information about the sale of vehicles in several copies;
• indicate any contact information in the ad;
• duplication of text in different advertisements indicating different models and brands of cars;
• submit advertisements to the section from spare parts stores and car dismantling shops, and also list in the ad text the names of spare parts for the car for disassembly.
10.2.3. Accessories and multimedia
10.2.3.1. It is allowed to post advertisements for the sale of accessories for vehicles, as well as audio, video equipment, navigators and/or their sale with installation.
10.2.3.2. In the section it is allowed to place one advertisement regarding the sale of one or several units (in the form of a set) of accessories or multimedia equipment for passenger vehicles with a certain set of characteristics with the obligatory indication of the price for one unit or for a set. It is allowed to list the brands/models of cars for which this accessory (set) is suitable.
10.2.3.3. The title of the ad must contain the name of a specific accessory for a passenger car, without general descriptions (for example, the title “New! Tuning accessories” is incorrect. The title “Radio for Toyota Corolla 2015” is correct).
10.2.3.4. Advertisements for the sale of an assortment of accessories (including accessories that are in no way related to each other, but with the note “set” or “sold only as a set”) should be published in the “Spare parts stores and car dismantling” section.
10.2.3.5. The use of watermarks on photographs when submitting an ad in the “Accessories and Multimedia” section is permitted only with the permission of the Site administration.
10.2.4. Oils and auto chemicals
10.2.4.1. It is allowed to post advertisements for the sale of all types of oils, liquids, lubricants, auto chemicals (gels, additives, car shampoos, etc.), as well as consumable spare parts for cars (belts, filters, spark plugs, etc.). p>
10.2.5. Tires
10.2.5.1. It is allowed to submit advertisements only for the sale of tires for passenger vehicles.
10.2.5.2. It is allowed to place one advertisement in the section regarding the sale of one or several units of tires (in the form of a set or completely identical ones) with the obligatory indication of the price for one unity, or per set. Advertisements for the sale of an assortment of tires should be published in the “Tire and Wheel Stores” section.
10.2.5.3. An ad may only contain one tire size (with the exception of one set of mixed-width tires - for the front and rear axles).
10.2.5.4. The advertisement allows the sale of tires together with rims and components.
10.2.6. Disks
10.2.6.1. It is allowed to submit advertisements only for the sale of wheels for passenger vehicles.
10.2.6.2. In the section it is allowed to place one advertisement regarding the sale of one or several units of wheel rims (in the form of a set or completely identical ones) with the obligatory indication of the price for one unit or for a set. Advertisements for the sale of an assortment of wheels should be published in the “Tires and Wheels Stores” section.
10.2.6.3. An advertisement may only indicate one wheel size (with the exception of one set of different-wide wheels - for the front and rear axles).
10.2.6.4. The advertisement allows the sale of rims together with tires and components.
10.2.7. Spare parts for commercial
10.2.7.1. It is allowed to submit advertisements for the sale of spare parts for commercial vehicles.
10.2.7.2. In this section, you are allowed to place one advertisement regarding the sale of one or more units (in the form of a set, repair kit, or completely identical) spare parts for commercial vehicles with a certain set of characteristics (catalog number, size, type, etc.) with the obligatory indication of the price for one unit, or per set.
10.2.7.3. The title of the ad must contain the name of a specific spare part for a commercial vehicle, without general descriptions (for example, the title “Spare parts for cars from the USA” is incorrect. The title “Side mirror Mercedes Sprinter 2012” is correct).
10.2.7.4. It is prohibited to indicate in the text and title of the advertisement more than one make/model of commercial vehicles for which this spare part is suitable.
10.3. Section "Services"
10.3.1. Car audio
10.3.1.1. It is allowed to post advertisements for services related to car audio and audio tuning. Advertisements for the sale of audio equipment without the corresponding service are prohibited.
10.3.2. Car wash
10.3.2.1. It is allowed to advertise car wash services with related services.
10.3.3. Car insurance
10.3.3.1. It is allowed to submit advertisements for any type of car insurance services.
10.3.4. Driving schools
10.3.4.1. It is allowed to post advertisements for driving school services and driving training services.
10.3.5. Auto electricians
10.3.5.1. It is allowed to submit advertisements for all services related to auto electrics.
10.3.6. Airbrush
10.3.6.1. It is allowed to post advertisements for the services of applying images to car bodies.
10.3.7. Opening a car, making keys
10.3.7.1. It is allowed to post advertisements for car opening services, key production and restoration, lock repair, and electronic key programming.
10.3.8. Cargo transportation
10.3.8.1. It is allowed to submit advertisements for all types of cargo transportation, manipulator services, car transporters.
10.3.9. Changing oils, liquids
10.3.9.1. It is allowed to submit advertisements for oil change services and all types of liquids. Advertisements for the sale of oils and liquids without the corresponding service are prohibited.
10.3.10. Interior reupholstery, covers
10.3.10.1. It is allowed to submit advertisements for reupholstery, restoration of interiors, covers, as well as for the manufacture of covers and capes. Advertisements for the sale of restoration materials without the corresponding service are prohibited.
10.3.11. Rental
10.3.11.1. It is allowed to submit advertisements for rental or rental of transport.
10.3.12. Bumper repair, auto plastic
10.3.12.1. It is allowed to submit advertisements for all types of bumper repairs and auto repairs.
10.3.13. Engine repair
10.3.13.1. It is allowed to submit advertisements for all types of engine repair services.
10.3.14. Gearbox repair
10.3.14.1. It is allowed to submit advertisements for all types of gearbox repair and diagnostic services.
10.3.15. Body repair
10.3.15.1. It is allowed to submit advertisements for all types of body repair services.
10.3.16. Repair of radiators, air conditioners
10.3.16.1. It is allowed to submit advertisements for all types of services for repairing radiators, car heaters, air conditioners, and refilling with freon.
10.3.17. Chassis repair
10.3.17.1. It is allowed to submit advertisements for all types of chassis repair services.
10.3.18. Fuel system repair
10.3.18.1. It is allowed to submit advertisements for repairs, diagnostics, flushing, and cleaning of the fuel system.
10.3.19. Signaling
10.3.19.1. It is allowed to submit advertisements for the installation of car alarms, selection, programming, unlocking, disabling and repair of key fobs.
10.3.20. Service stations, car services
10.3.20.1. It is allowed to submit advertisements for all types of service stations and car services.
10.3.21. Taxi
10.3.21.1. It is allowed to submit advertisements for all types of passenger transportation by passenger vehicles, and for the rental of a passenger car with a driver.
10.3.22. Technical inspection
10.3.22.1. It is allowed to submit advertisements for the services of technical inspection stations.
10.3.23. Tinting
10.3.23.1. It is allowed to post advertisements for tinting services, protection of car windows and headlights. Advertisements for the sale of tinting and protection materials without the corresponding service are prohibited.
10.3.24. Tuning
10.3.24.1. It is allowed to submit advertisements for body and component tuning services. Advertisements for the sale of tuning materials (paints, films, car vinyl) without the corresponding service are prohibited.
10.3.25. Auto glass installation
10.3.25.1. It is allowed to submit advertisements for the installation and restoration of auto glass. Advertisements for the sale of materials for installing auto glass without the corresponding service are prohibited.
10.3.26. Dry cleaning, polishing
10.3.26.1. It is allowed to post advertisements for interior dry cleaning and polishing services.
10.3.27. Tire service
10.3.27.1. It is allowed to submit advertisements for all types of tire fitting services (vulcanization, geometry, balancing, etc.).
10.3.28. Noise insulation
10.3.28.1. It is allowed to submit advertisements for noise, sound, vibration and heat insulation services. Advertisements for the sale of insulation materials without the corresponding service are prohibited.
10.3.29. Tow truck
10.3.29.1. It is allowed to post advertisements for tow truck services.
10.3.30. Car purchase
10.3.30.1. It is allowed to submit advertisements for the purchase of passenger cars, trucks and special equipment.
10.3.31. Other
10.3.31.1. You are allowed to post advertisements for any services.
10.4. Section "Commercial" and "Special equipment"
10.4.1. Trucks
10.4.1.1. It is allowed to submit advertisements for the sale of trucks.
10.4.1.2. One ad is allowed to sell one unit of equipment.
10.4.2. Buses
10.4.2.1. It is allowed to post advertisements for the sale of buses.
10.4.2.2. One ad is allowed to sell one unit of equipment.
10.4.3. Special equipment
10.4.3.1. It is permitted to submit advertisements for the sale of the types of special equipment listed in the submission form. If a certain type of special equipment is not in the list of acceptable ones and the equipment does not have its own engine (of any type), then it is considered a “Spare part” for the special equipment.
10.4.3.2. One ad is allowed to sell one unit of equipment.
10.4.4. In advertisements in the “Commercial” section, it is prohibited to upload images processed with a graphic editor (including applying text), except in cases of changing the format, size, or minor retouching (does not apply to the “Sellers of special equipment” section)
The publication of advertisements that violate these rules is not guaranteed. Payment for additional services (publishing an ad over the limit, purchasing a VIP service, highlighting it in color, etc.) does not guarantee that the ad will not be deleted if you violated the rules, and funds for services provided will not be returned.
11.1. These Rules establish the following limits on the number of advertisements on the Site that one User can submit for free using one phone number and/or one email:
11.1.1. In the sections “Cars”, “Commercial”, “Special equipment”, “Moto”, “Services”, “Buy” – in each category there are 8 (eight) advertisements;
11.1.2. In the "Spare parts" section - 100 (one hundred) advertisements.
12.1. Users can order the following paid services on Carspot.co.nz:
- Automotive business;
- VIP;
- Highlight;
- Auto UP;
- Label "Urgent".
In accordance with the Law of the New Zealand “On Personal Information”, personal data of users is processed by ESPIRU LLC, registered in accordance with the legislation of the New Zealand, located at the address: Bishkek, blvd. Erkindik 64B.
Using Carspot.co.nz and/or related services and/or other tools in carspot.co.nz, the User provides his consent to Carspot for the collection and processing of his personal data, such as user name, residential address, email address, contact phone number, taxpayer identification number, other contact information, IP addresses, other user data in the process of using the Carspot.co.nz Services. The User independently and voluntarily decides to provide the Carspot and/or place in the public domain personal and other information about the User (last name, first name, patronymic or nickname of the User, email address, mobile phone number, as well as any other information provided by the User, in including those contained in messages sent to other Users through the feedback form in the Carspot.co.nz interface, and comments sent through the form for adding a comment to the Advertisement, etc.). The user also provides his consent to the cross-border transfer of personal data.
When the User creates an account on Carspot.co.nz, the Carspot may request certain information, such as a current email address, address, first and last name, phone number and other information, including photographs, which can be uploaded to its account or when using certain Services on Carspot.co.nz
As part of the activities of its website, the Carspot can post information, including personal and contact information, necessary for making transactions between a buyer and a seller, for sending messages and communicating between users, and making payments.
When Users contact support, the Carspot may - as part of its operation - collect personal information necessary to fulfill the User's request and receive feedback if necessary. The Carspot can also contact the User using the existing contact information that is indicated in the personal account. The Carspot may also collect other information about communications with Users, such as any support requests submitted by Users or any feedback provided by Users.
The Carspot takes all necessary measures to protect the User’s personal data from unauthorized access by third parties.
13.1. When using Carspot.co.nz, the User undertakes to provide only reliable Information and bears full responsibility for the information provided. The User undertakes to promptly update the Information by editing it on Carspot.co.nz. The Carspot has the right to request, and the User is obliged to provide upon such request, documents and information necessary to identify the User as a party to the User Agreement and/or the party using the relevant Service, as well as documents confirming the accuracy of the information provided and the legality of the use/offer of the Product and/or communication User with the Product specified in the Advertisement.
13.2. In the process of using the Carspot.co.nz Services (including during Registration, interaction with other Users through the Carspot.co.nz interface, posting Advertisements, viewing Carspot.co.nz pages, etc.), the User independently and voluntarily makes a decision on the provision of a Carspot or placement in the public domain of personal and other information about the User (last name, first name, patronymic or nickname of the User, email address, mobile phone number, as well as any other information provided by the User, including contained in messages sent to other Users through the feedback form in the Carspot.co.nz interface, and comments sent through the form for adding a comment to the Advertisement, etc.) for the purposes of executing the User Agreement, and also hereby declares its consent to the processing by the Carspot of the User’s personal and other data, cross-border transfer of personal data, including for the purposes of: providing advisory support to Users in connection with the use of Carspot.co.nz, checking Advertisements for compliance with the User Agreement, delivering messages to other Users, obtaining statistical and analytical data to improve the functioning of Carspot.co.nz and/or Services, expanding the range of Services provided, receiving information and/or advertising messages from the Carspot or third parties, preventing or suppressing illegal and/or unauthorized actions of Users or third parties, ensuring compliance with the requirements of the current legislation of the New Zealand. The machine takes all necessary measures to protect the User’s personal data from unauthorized access by third parties.
13.3. All information posted by the User on Carspot.co.nz is posted by him for the User’s sale of his property and/or services and/or in other interests of the User and, accordingly, the User posts this or that information about himself solely in his own interests, including to facilitate establishing a connection with the User.
13.4. By posting Advertisements on Carspot.co.nz, the User makes the Information specified in the Advertisement publicly available and understands that the posted information is published on Carspot.co.nz in the public domain, that is, available for review to any visitor to Carspot.co.nz (an unlimited number of persons) in all countries world where it is possible to use the Internet and access the site, accordingly the User understands and assumes all the risks associated with such placement of information, including, but not limited to: the risk of an email address being included in spam mailing lists; messages, the risk of the email address getting to various types of scammers, the risk of the phone number getting to SMS spammers and/or SMS scammers and other risks arising from such placement of information.
13.5. The machine is not obliged to carry out a preliminary check of Information of any kind posted and/or distributed by the User through Carspot.co.nz. Carspot has the right, at its discretion, to refuse the User to post and/or distribute any Information or to delete any Information that is posted by the User on Carspot.co.nz. The User acknowledges and agrees that he must independently assess all risks associated with the placement and distribution of any Information, including assessing the reliability, completeness or usefulness of it.
13.6. The Carspot has the right not to consider the User’s requests: those that do not contain the information and documents necessary to consider the request; containing false information and (or) documents that do not have any signs of reliability; in relation to questions on which the Carspot previously sent a response to the User (repeated requests); containing insults, threats or appeals expressed in a sharply negative form; sent in violation of other conditions and procedures for considering requests provided by the Carspot.
13.7. The User agrees that the Carspot may collect anonymized statistical data about Carspot.co.nz Users. The user agrees to the transfer to third parties of anonymized statistical data, including for the purposes of their processing, to ensure the functioning of Carspot.co.nz, Services, and the implementation of affiliate and other programs of Carspot.co.nz. The purpose of processing the User's data is to provide the latter with the opportunity to use the Services and grant the rights to use additional functional (software) capabilities of Carspot.co.nz, conduct advertising campaigns, provide targeted advertising and Services, conduct statistical research and analyze the obtained statistical data, and carry out other actions described in User Agreement.
13.8. The User agrees that Carspot.co.nz has the right to use the technical data about the car provided by the User in information ionic and commercial purposes for transfer to third parties, without the consent of the User.
14.1. The User undertakes to act exclusively in accordance with the current legislation and the Carspot.co.nz User Agreement, and also bear full responsibility in accordance with the legislation of the New Zealand for his own actions and inactions on Carspot.co.nz and when using the Services.
14.2. The Carspot.co.nz Services available to the User may be used exclusively for the purposes for which such Services are intended by the Carspot. The User is prohibited from using the Services, as well as any information received on Carspot.co.nz for other purposes.
14.3. The user undertakes not to use automatic or other programs to gain access to Carspot.co.nz without the written permission of Carspot. Without the permission of Carspot, it is also not permitted to use, distribute, copy and/or extract from Carspot.co.nz manually or automatically (using software) any materials or information (including Advertisements, Product description texts, photographs, etc.).
14.4. The use of computer programs that allow you to view or post Advertisements on Carspot.co.nz, bypassing the normal procedure for posting Advertisements (for example, using programs to autoload Advertisements), in the absence of written permission from Carspot, is strictly prohibited and may lead to termination and/or suspension of the publication of Advertisements, blocking access to your Personal Account and/or Carspot.co.nz.
14.5. The user also undertakes:
- do not take any actions that may lead to a disproportionately large load on the Carspot.co.nz infrastructure;
- do not copy, reproduce, modify, distribute or present to the public any information contained on Carspot.co.nz (except for Information provided by the User himself) without the prior written permission of Carspot and any third party;
- do not interfere with the operation of Carspot.co.nz, and also do not interfere with the operation of automatic systems or processes in order to block or limit access to Carspot.co.nz.
14.6. In order to suppress or prevent violation of the User Agreement and/or causing damage to the Carspot (for example, DDoS attacks or other hacker attacks, unauthorized use of software by the Carspot, including for downloading Advertisements, etc.), the Carspot has the right to limit the access of Users or third parties to Carspot.co.nz by blocking access to Carspot.co.nz for the corresponding IP address or range of IP addresses.
14.7. By accessing Carspot.co.nz, the User expresses his consent to receive advertising information posted on Carspot.co.nz by third parties. The user understands and agrees that Carspot.co.nz does not determine the content and is not responsible for such information, including sites that may be linked
14.8. The Carspot.co.nz User undertakes not to use any data provided by another User without the written permission of the person who posted such Information, or without confirming in any other way the right to use such Information. All information received by the User about other Users in connection with the use of Carspot.co.nz can only be used to complete and execute transactions in relation to the Goods. Thus, the User is prohibited from using the email address and/or telephone number of another User, personal messaging and comment services for the purposes of direct advertising or other sending of unsolicited electronic messages, as well as for other illegal actions or actions committed without knowledge and/or consent the other side.
14.9. If the User has claims against another User in connection with the latter’s use of the Services and/or Advertisements posted by him, the User is obliged to present these claims to the appropriate person (Seller) and resolve the claims independently and without the participation of the Carspot.
14.10. The User understands and accepts that the Carspot does not always verify the information published on Carspot.co.nz by Users. Some of the information contained in the Advertisements may be offensive, harmful, incorrect or misleading. Carspot recommends that Users exercise caution and use common sense when using information on Carspot.co.nz. The user must take into account that his counterparty may impersonate another person, be a minor, post distorted information, etc. Use of the Services implies that the User understands and accepts these risks, and also agrees that the Carspot is not responsible for the actions or inactions of other Users.
14.11. The user undertakes to exercise caution when choosing a counterparty, at his own responsibility. You make a decision on a transaction based on the fact that the Advertisement is posted on Carspot.co.nz, independently verifying that the offer, sale and/or purchase of any Product in the Advertisement on Carspot.co.nz is valid and legal.
15.1. The User is responsible for actions taken on Carspot.co.nz in accordance with the current legislation of the New Zealand, including responsibility for the content of the information posted by him and violation of the rights of third parties in relation to Goods and/or information posted on Carspot.co.nz.
15.2. The User is responsible for the transactions offered in relation to the Goods and concluded in connection with them, for the choice of counterparties for the transaction and the consequences arising from the transaction. All transactions regarding Goods are concluded between Users directly. Carspot is not a participant and/or intermediary of transactions made by Users based on information received on Carspot.co.nz, does not control and is not responsible for such transactions.
15.3. Carspot.co.nz is a tool that provides the opportunity for Users to post Advertisements in relation to Products, the sale and/or purchase of which is permitted by law and the User Agreement. At the same time, the Carspot does not always check the Advertisements posted by Users. Therefore, the quality, safety, legality and conformity of the Product to its description, as well as the ability of the Seller to sell and/or the Buyer to purchase the Product are beyond the control of the Carspot. In this connection, the Carspot is not responsible for the content of information provided by Users, including the content of Advertisements, Users’ use of trademarks, third-party logos and the terms of the Seller’s offer.
15.4. Carspot is not responsible for the loss of information by the User, as well as for distortion of information or loss of messages received using communication forms on Carspot.co.nz.
7.5. Taking into account the principles of construction and operation of the Internet, the Services are provided “as is”, this means that the Carspot does not provide any guarantees in relation to the Services, in particular, the Carspot does not guarantee to the User that:
- Services, their direct or indirect effect and quality will meet the requirements and goals of the User;
- Services will be provided continuously, reliably and without errors;
- The results that will be obtained through the use of the Services will be accurate, reliable and meet the User's expectations.
15.6. The User agrees that the Carspot is not responsible for possible losses caused to the User in connection with the adoption of measures to suppress or prevent violations on Carspot.co.nz related to restricting/blocking Users’ access to Carspot.co.nz.
15.7. The machine is in no way connected with any information provided by the User, including the content of Advertisements provided and/or posted by Users on Carspot.co.nz, and is not obliged to verify the content, authenticity and safety of such information or its components, as well as its compliance with the requirements of current legislation and availability Users have the necessary rights to distribute and/or use it.
16.1. The holder of exclusive rights to Carspot.co.nz and Mobile applications, including, but not limited to the domain name, logo posted on Carspot.co.nz, trademark Carspot.co.nz, databases, all technical developments that allow the use of Carspot.co.nz is Carspot. The user or other person does not have the right to use Carspot.co.nz, Mobile Applications or Services in ways not provided for in this User Agreement without the written permission of Carspot, including extracting Information in any form in ways not provided for in the User Agreement.
16.2. Information and news materials of the site, the copyright of which belongs to Carspot, can be reproduced in any media, on Internet servers, provided there is a link to Carspot.co.nz; when posted on the Internet, an active hyperlink to Carspot.co.nz is required.< /p>
16.3. Exclusive rights to the results of intellectual activity included in the Information provided by Users belong to the respective Users and copyright holders.
16.4. In order to fulfill this User Agreement, conduct competitions, promotions, announce and inform Users and other similar events, exercise the legal rights and interests of the Carspot and ensure the functioning of Carspot.co.nz, the User grants the Carspot a universally valid, perpetual right to use the Information (including photographs, text descriptions Products, trademarks, logos, etc.) in any way at all known or unknown information media during the entire period of validity of the exclusive right, as well as transfer such right to third parties. The User permits the use of materials as part of the Information without indicating the name of the author, including the transfer of information to third parties for informational and commercial purposes, and also guarantees that the Information provided does not violate any rights of third parties, including exclusive rights.
17.1. The Carspot has the right, and the User hereby consents to this, to transfer its rights and/or obligations under this User Agreement, both in whole and in part, to a third party.
17.2. In the event of the transfer of rights and/or obligations, either in whole or in part, under this User Agreement to a third party, the third party has the right to provide similar or similar services on another site.
18.1. This User Agreement comes into force from the moment the User begins using the Carspot.co.nz Services, regardless of the fact of User Registration or placement of an Advertisement on Carspot.co.nz, and is valid indefinitely.
